Professional Negligence

At some point almost everyone will have the need to consult or engage with professionals, whether lawyers, accountants, surveyors or others. Businesses are required to use professionals on a regular basis.

On most occasions the professionals fulfil their role well, but sometimes they do not and redress is required.

We bring to this work the same professional approach which is evident across our dispute resolution practice. The manner in which such claims are conducted is precisely regulated by the Court’s rules and with most defendant professionals represented by insurers, whose business is to put all claims to rigorous testing – both with regard to liability and the quantum of damages – it is essential that we help our clients to understand the process, the role they must play and the procedure to be followed. Our approach is guided also by the insight that many of the team have in acting for professionals in the same sort of claims for many years.

The parties to such claims are required by the Courts to adopt as constructive an approach as possible, at all times considering the desirability of seeking a negotiated settlement, and we ensure that clients understand the alternatives, in particular by analysing the potential cost/benefit of any course of action.
